This document (“Terms and Conditions”) is an electronic record in terms of the Information Technology Act, 2000 and the rules made thereunder, as applicable, and the amended provisions pertaining to electronic records in various statutes, as amended from time to time. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, as amended from time to time, which requires publishing the rules, regulations, privacy policy and terms for access or usage of the website https://www.novarixhealthcare.com and its mobile application (collectively, the “Platform”).

1. INTRODUCTION

Novarix Health Care (“NOVARIXHEALTHCARE.COM”, “we”, “us”, or “our”) provides services to individuals accessing or using its licensed retail stores or the NOVARIXHEALTHCARE.COM Platform for any purpose (“User”, “you”, “your”). The Platform is owned and operated by NOVARIXHEALTHCARE.COM, a company incorporated under the Companies Act, 2013.

By accessing, browsing, or using the Platform and availing the services (“Services”), you agree to be bound by these Terms and Conditions, read together with the Privacy Policy available on the Platform. If you do not agree with any part of these Terms and Conditions, you must discontinue access to or use of the Platform.

The Platform facilitates online purchase of pharmaceutical products including prescription medicines, over-the-counter medicines, medical devices, and related products sold by NOVARIXHEALTHCARE.COM through its licensed premises.

2. ELIGIBILITY

By using the Platform, you represent and warrant that:

You are at least 18 years of age, or you are accessing the Platform under the supervision of a parent or legal guardian, who shall be deemed the end-user of the Services.
If you are below 18 years of age, transactions may be carried out on your behalf only by your parent or legal guardian.
You will not purchase products prohibited for sale to minors or meant exclusively for adult consumption.
You are legally competent to contract under the Indian Contract Act, 1872.
You have not been previously suspended or removed from the Platform.

NOVARIXHEALTHCARE.COM reserves the right to terminate access if it is discovered that you do not meet the eligibility requirements.

3. GOVERNING LAWS

These Terms and Conditions are governed by and comply with applicable Indian laws, including but not limited to:

Indian Contract Act, 1872
Information Technology Act, 2000 and applicable rules
Drugs and Cosmetics Act, 1940 and Rules, 1945
Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954
Indian Medical Council Act, 1956
Pharmacy Act, 1948
Consumer Protection Act, 2019 and Consumer Protection (E-Commerce) Rules, 2020

4. OUR SERVICES

Through the Platform, NOVARIXHEALTHCARE.COM provides the following Services:

Display, advertisement, sale, and delivery of medicines, over-the-counter drugs, medical devices, cosmetics, food products, and other permitted consumer goods (“Products”); and
Any other services introduced from time to time.

All sales are undertaken solely by NOVARIXHEALTHCARE.COM through its licensed premises.

5. USER OBLIGATIONS AND USE OF PLATFORM

By using the Platform, you agree to:

Provide accurate, complete, and up-to-date information;
Maintain confidentiality of your login credentials;
Use the Platform only for lawful purposes;
Not misuse, copy, modify, distribute, or commercially exploit any content without authorization;
Not impersonate any individual or entity;
Not resell Products purchased from the Platform.

NOVARIXHEALTHCARE.COM reserves the right to refuse service or terminate accounts at its discretion.

6. DELIVERY, PAYMENTS, AND CANCELLATIONS

Delivery timelines are indicative and not guaranteed.
Delivery charges and applicable fees will be displayed at checkout.
Cash on Delivery (COD) is available subject to conditions.
Failure to accept delivery or make payment may result in cancellation without liability to NOVARIXHEALTHCARE.COM.
Refunds shall be processed as per the Payment, Returns, and Refund Policy.

Inter-state medicine delivery, where applicable, may be fulfilled through third-party partners, whose actions are governed by their respective terms.

7. PRESCRIPTION MEDICINES

Valid prescriptions issued by a registered medical practitioner are mandatory for prescription medicines.
Prescriptions are verified and medicines dispensed under supervision of a registered pharmacist.
NOVARIXHEALTHCARE.COM reserves the right to reject orders that do not comply with legal requirements.

8. PROHIBITED CONTENT

Users shall not upload or transmit content that is unlawful, harmful, misleading, defamatory, obscene, abusive, infringing, or otherwise prohibited under applicable law.

Violation may result in removal of content and termination of access.

9. INTELLECTUAL PROPERTY

All content, trademarks, logos, and materials on the Platform are owned by or licensed to NOVARIXHEALTHCARE.COM and are protected under applicable laws. Unauthorized use is strictly prohibited.

10. LIMITATION OF LIABILITY

To the fullest extent permitted by law, NOVARIXHEALTHCARE.COM shall not be liable for indirect, incidental, consequential, or punitive damages. Aggregate liability, if any, shall not exceed the amount paid by you for the relevant Product or Service.

11. INDEMNITY

You agree to indemnify and hold harmless NOVARIXHEALTHCARE.COM and its affiliates against any claims arising from your breach of these Terms, misuse of the Platform, or violation of law.

12. TERMINATION

NOVARIXHEALTHCARE.COM reserves the right to suspend or terminate Services without notice in case of violation of these Terms or applicable laws.

13. FORCE MAJEURE

NOVARIXHEALTHCARE.COM shall not be liable for delays or failures caused by events beyond reasonable control, including natural disasters, government actions, or disruptions in services.

14. AMENDMENTS

These Terms may be updated from time to time. Continued use of the Platform constitutes acceptance of the revised Terms.

15. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts at Hyderabad, India.
